Rental Agreement

1. Parties

This Vacation Rental Agreement ("Agreement") is entered into between Beach Vibes 1229, LLC ("Host"), located at 239 Beach City Rd, Unit 1229, Hilton Head Island, SC 29926, and the guest ("Guest") identified at the time of booking.

2. Property

The property subject to this Agreement is located at 239 Beach City Rd, Unit 1229, Hilton Head Island, SC 29926, within The Spa on Port Royal Sound, Hilton Head Island, South Carolina ("Property"). The Property is a Entire Condo with 2 bedrooms and 2 bathrooms, accommodating a maximum of 4 guests.

3. Check-In & Check-Out

Check-in time is 4:00 PM. Check-out time is 10:00 AM. Entry is via Keyless self check-in with smart lock. Detailed check-in instructions will be sent 3 days prior to arrival.

4. Rental Rate & Taxes

The total rental rate includes the nightly accommodation rate, a professional cleaning fee, and applicable South Carolina state and local accommodations tax (11%). Accommodations tax is remitted by the Host on behalf of the Guest — no additional tax charges apply.

The cleaning fee is a mandatory charge applied to every reservation regardless of stay length.

5. Payment Terms

A non-refundable deposit of 50% of the total rental amount is due at the time of booking to secure the reservation. The remaining balance is due 30 days prior to the check-in date. If the reservation is made within 30 days of the check-in date, the full rental amount is due at the time of booking.

Failure to submit timely payments may result in cancellation of the reservation at Host's discretion.

6. Cancellation Policy

This Agreement does not include trip insurance. The following cancellation terms apply:

  • Cancellations made more than 30 days prior to check-in: The deposit is forfeited; all other payments made will be refunded.
  • Cancellations made within 30 days of check-in: No refund will be granted for any payments made. The full amount paid is forfeited.
  • Early departure does not entitle the Guest to any refund of unused nights. No partial refunds will be issued for early check-out for any reason.
  • Guests are encouraged to purchase independent travel insurance to protect against unforeseen cancellations.

    7. Guest Policies

    7.1 Authorized Guests & Occupancy

    The unit may be occupied by no more than 4 persons at any time, including overnight guests. The primary guest (named at booking) is responsible for the conduct of all visitors and guests. Unauthorized overcrowding may result in immediate termination of the reservation without refund.

    7.2 Age Requirement

    The primary guest must be at least 25 years of age to book. By completing a booking, the Guest represents that they meet this requirement.

    7.3 No Smoking

    Smoking of any substance — including cigarettes, cigars, e-cigarettes, marijuana, or any other product — is strictly prohibited inside the unit and on all balconies, porches, and patios. Evidence of smoking indoors will result in a remediation fee of no less than $500, in addition to any cleaning costs incurred.

    7.4 No Parties or Events

    The unit is rented for residential use only. Parties, events, gatherings, or commercial activities are strictly prohibited. Quiet hours as established by the resort must be respected. Violations may result in immediate termination of the reservation without refund.

    7.5 No Pets

    Pets are not permitted at the resort. Unauthorized pets will result in a fine of $400 to $800 per violation per resort policy and may result in early termination of the reservation. Any damages caused by pets are the sole financial responsibility of the Guest.

    8. Property & Amenities

    The unit is provided fully furnished and includes the following for Guest use:

  • Fully equipped kitchen with cookware, utensils, dishes, and small appliances
  • Coffee bar (Keurig & French Press)
  • In-unit washer and dryer
  • Beach gear (chairs, umbrella)
  • High-speed WiFi and streaming TV in both bedrooms
  • Access to all resort amenities including 3 pools (1 indoor heated), indoor hot tub, sauna, fitness center, and tennis courts
  • Guest agrees to use all amenities and furnishings responsibly and in accordance with their intended purpose.

    9. Maintenance & Damage Responsibility

  • Guest agrees to maintain the unit in a clean and orderly condition throughout the stay.
  • Guest agrees to report any maintenance needs or concerns to the Host promptly.
  • Guest is responsible for all damage, breakage, or loss of property caused by Guest or Guest's visitors beyond normal wear and tear. The cost of any such damage will be charged to the Guest and is due within 10 days of invoice.
  • Guest agrees not to rearrange or remove furniture, fixtures, or appliances from the unit.
  • 10. House Rules & Resort Regulations

    Please be respectful of the property and the resort. This is a family-owned residence that we are excited to share with you.

  • Quiet Hours: 10:00 PM to 8:00 AM. Please be courteous to neighboring units.
  • No Smoking: This is a non-smoking residence, including all balconies and porches. Smoking of any substance is subject to a $500 fine per incident.
  • No Pets: The resort enforces a strict no-pet policy. Fines imposed by the resort are the sole responsibility of the Guest.
  • No Parties or Events: No events, parties, or large gatherings of any kind.
  • No Elevator: The unit is located on the 2nd floor and requires climbing one flight of stairs. Guests with mobility concerns should plan accordingly.
  • No Electric Bikes: E-bikes and electric scooters are not permitted on resort property.
  • No Watercraft: Parking with any watercraft is not permitted on resort property. This includes boats, kayaks, jet skis, canoes, paddleboards, or similar equipment.
  • Airport Notice: A nearby airport is in the flight path of the property. Guests may occasionally hear aircraft noise during takeoff and landing.
  • 11. Parking

    Parking is available on resort property at a rate of $25.00 per vehicle for the duration of the stay, payable directly to the resort via credit card upon arrival.

    There are no assigned spaces. Parking is on a first-come, first-served basis in designated guest parking areas. Vehicles must be properly registered and display any required resort parking permit. Watercraft, trailers, and oversized vehicles are not permitted.

    12. Damage Reporting

  • Guest must inspect the unit upon check-in and notify the Host of any pre-existing damage or maintenance concerns within 24 hours of arrival. Failure to report may result in Guest being held responsible for such conditions upon check-out.
  • Any damage, breakage, or malfunction occurring during the stay must be reported to the Host promptly by phone. Guest shall not attempt repairs without prior authorization.
  • Guest is financially responsible for all damage beyond normal wear and tear caused by Guest or Guest's visitors. Costs will be invoiced and due within 10 days of notice.
  • 13. No Commercial Use or Subletting

    The unit is rented solely for private residential use during the stated reservation period. Guest may not sublet, re-rent, list, or otherwise transfer occupancy rights to any third party. The unit may not be used for commercial activities, photography or film shoots, social media content production, or any income-generating purpose without prior written consent from the Host. Violation of this provision is grounds for immediate termination of the Agreement without refund.

    14. Resort Rules & Fine Schedule

    Guest agrees to comply with all rules, regulations, and policies of The Spa on Port Royal Sound, as posted on the grounds and as may be updated from time to time. The full fine schedule is available upon request and posted on the property. Violations and resulting fines are the sole financial responsibility of the Guest and must be reimbursed to the Host within 10 days of notice.

    The following resort fines are specifically acknowledged by Guest:

  • Pets on Property: $400 (1st offense), $600 (2nd offense), $800 (3rd offense). This applies regardless of pet size or duration.
  • Noise Violation: $50 (1st offense), $75 (2nd offense), $150 (3rd offense). Quiet hours are enforced from 10:00 PM to 8:00 AM.
  • 15. Liability & Hold Harmless

    Guest agrees to hold harmless and indemnify the Host, Beach Vibes 1229, LLC, from and against any claims, damages, losses, or expenses arising from Guest's use of the Property, including but not limited to personal injury, property damage, or any other liability. Guest acknowledges that use of amenities including but not limited to pools, hot tub, sauna, beach access, and fitness facilities is at Guest's own risk.

    16. General Provisions

  • Governing Law: This Agreement shall be governed by the laws of the State of South Carolina. Any disputes arising under this Agreement shall be resolved in the courts of Beaufort County, South Carolina.
  • Entire Agreement: This document constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, or agreements.
  • Amendments: Any modifications to this Agreement must be made in writing and agreed to by both parties.
  • Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
  • 17. Acceptance

    By completing a booking and making payment, the Guest acknowledges that they have read, understood, and agree to all terms and conditions set forth in this Rental Agreement.
